hi guys was looking through via arena, and found this file :
http://www.viaarena.com/guides/WinCE/fastboot%20v2.03.zip
problem is, running
strings */BIOS_*.BIN | grep inux
gives 2 mentions of LinuxBios for each binary bios file, which makes the whole thing suspect...
should via be hit with some GPL cluestick ?

Have you asked them for the code?

no, I haven't... shouldn't it be readily available from the download page at http://www.viaarena.com/default.aspx? PageID=22&DSCat=41&DCatType=3 where the files are pointed from ?

The GPL is not quite that demanding. But it comes close.
Anyway it is best to start with giving companies the benefit of the doubt. It may be they just forgot, or you did not see it.
If they actually refuse the code that is a separate issue entirely.

yes, you've got to a) buy the software from them or a product running the software b) ask for the software
or so I understand.

Actually, no, all you have to do is aquire the software in binary form. If source is not included, then they must provide it through specific means outlined in the GPL whenever requested.
Wether it's sold or given gratis is of no consequence, as I've known..

yeah, that's what I was attempting to say.
For example, we bought a Cray XD1 and asked for linuxbios source; no response yet.

Fastboot is based on LinuxBIOS....that's pretty common knowledge, no?

Send them a registered letter via USPS mail requesting the source code, and specify the URL of the code, the source code in question, the license, and a specific request for their modified sourcecode under the terms of the license. Make sure to give them a date for compliance.
Make sure you have a copy of the letter, and if they don't comply, I'm sure the happy lawyers down at the FSF would be happy to contact them..
Rule of thumb: Do not make a public scene about this. Handle this quietly until public exposure is a last resort; let the FSF handle it. If you make a public scene (ie, /. posting) VIA is much less likely to be amicable in the future, especially since we *WANT* them developing GPL code and being part of the community, not setting policies like "never touch GPLed code, it's a minefield".

if you're sure and have the time, sounds good.
I have also asked Cray for the LinuxBIOS source for the XD1 and received no response as of yet. This is getting to be a problem.

This is not new for Via:
Via "violates" GNU GPL with Padlock http://www.theinquirer.net/?article=15329
but they did comply after being informed http://linuxdevices.com/news/NS4520757633.html

it may be that it's different groups each time. Remember, via is a BIG company.
